Dear Unit Owner:
In our previous letter, we informed you that we have been made aware that the Bases Conversion and Development Authority (BCDA) has started posting “Under Custodia Legis” signs on the doors of some of your units.
We also informed you of our position that these attempts to deprive you of your unit WITHOUT DUE PROCESS or JUST COMPENSATION violate your rights as the lawful owner of your units.
Moreover we informed you that before being unceremoniously taken out by BCDA, our Hotel Managers attempted to explain our position to the Sheriff involved. We then recommended that should our position continue to be ignored, we recommend that we pull out all your movables, furniture, fixtures and equipment, to preserve your assets and continue this fight in courts.
We give you our highest assurance that we are here to support protection of your rights over your units.
Since the take-over by BCDA of The Manor and The Forest Lodge last 6th January 2025, we have initiated to take inventory of all the movable assets of The Manor and The Forest Lodge – excluding those moveable assets inside your units. The movable assets include furniture, fixtures, equipment, vehicles, operating supplies and consumables.
An appraisal by CUERVO APPRAISERS, INC. is presently being conducted to determine the valuation of these movable assets in the inventory. Once the Appraisal Report of Cuervo Appraisers, Inc. is finalized, we will furnish the said report to all unit owners.
In accordance with the Notice to Vacate served to The Manor and The Forest Lodge, in the coming days, we will pull out all these movable assets for proper disposition.
BCDA has been urged to continue to respect and recognize your rights over your units. If BCDA responds to this call in a positive way, then all the existing movables in the inventory will not be pulled out to allow uninterrupted operation of the hotels and enjoyment of the building amenities by the residents of The Manor and The Forest Lodge. However, if by the time the inventory and appraisal is completed and BCDA remains unresponsive to this call for justice to our unit owners, we will proceed to pull out all the movables for proper disposition.
